The most recent meeting of the Michigan Underground Storage Tank Authority (MUSTA) Board was held last week. By now most of our clients are aware of the New Michigan UST Corrective Action Fund (Fund), but there are still a number of questions concerning Financial Responsibility (FR).
For those that need a refresher on when and why the Fund was enacted, please refer to our last article, New Underground Storage Tank Corrective Action Fund, written by Envirologic s Paul French earlier this year. Paul is our team's go-to resource for all things UST and has been through two previous iterations of this program. At the most recent MUSTA Board meeting, it was announced the EPA approved the fund as an acceptable financial assurance mechanism. If you choose to use the fund for financial responsibility, you must apply for eligibility and receive a favorable determination from MUSTA prior to cancelling your insurance.
If you are a member of MPA/MACS, you should have recently received a comprehensive fact sheet via email, which describes how to use the new fund for means of FR. They list a number of Important Points to Remember, along with Step-by-Step instructions about how to move through the process of eligibility including questions to help you understand eligibility. MUSTA expects to have all of the claim forms available online by 12/1/15 at www.michigan.gov/deqmusta and will be prepared to begin accepting claims starting 1/1/16.
