Funding Sources for LUST Sites

The Michigan Underground Storage Tank Authority (MUSTA) and the Underground Storage Tank Cleanup Fund (Fund) were created on December 14, 2014, under amendments to Part 215. The Fund annually receives the first $20 million that is collected from the environmental protection regulatory fee, which is a fee of 7/8 cent per gallon of refined petroleum sold for resale or consumption in Michigan.

What are the Objectives of Part 215?

  • To fund corrective actions to address releases from refined petroleum underground storage tank (UST) systems and help owners and operators (O/Os) in achieving compliance with Part 213, Leaking Underground Storage Tanks (LUSTs) of Act 451 of 1994.
  • To assist O/Os of petroleum USTs in meeting financial responsibility requirements, pursuant to Part 211, UST Regulations of Act 451 of 1994.
